SilentNode – Terms of Service

1. Acceptance of Terms

By purchasing, accessing, or using any services provided by SilentNode (“we”, “us”, “our”), you (“Customer”, “Client”, “User”) agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Eligibility

You must be at least 18 years old or have legal parental/guardian consent to use our services. By using SilentNode, you confirm that all information you provide is accurate and lawful.

3. Services Provided

SilentNode offers:

  • Discord bot hosting
  • Website hosting
  • Windows‑based VPS hosting
  • Automated provisioning systems
  • Custom dashboards and management panels

We reserve the right to modify, suspend, or discontinue any service at any time.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity performed under your account
  • Ensuring your hosted content complies with these Terms

SilentNode is not liable for unauthorized access resulting from your failure to secure your account.

5. Prohibited Use

You may not use SilentNode services for:

  • Hosting malware, viruses, or malicious bots
  • DDoS attacks, botnets, or network abuse
  • Illegal activities under U.S. or international law
  • Copyright infringement
  • Harassment, hate speech, or abusive content
  • Hosting content that violates Discord’s Terms of Service
  • Attempting to bypass resource limits or security systems

Violation may result in immediate suspension or termination without refund.

6. Resource Usage

You agree not to exceed the allocated CPU, RAM, storage, or bandwidth limits of your plan. Excessive usage that impacts other customers may result in throttling, suspension, or required plan upgrades.

7. Payments & Billing

  • All payments are billed automatically unless canceled.
  • SilentNode uses third‑party processors (e.g., Stripe, PayPal).
  • Failure to pay may result in service suspension or termination.
  • Chargebacks or payment disputes may result in account termination.
  • All fees are non‑refundable unless required by law.

8. Service Provisioning

Services are provisioned automatically after payment.

You agree that:

  • Provisioning times may vary
  • Automated systems may require manual review
  • SilentNode is not responsible for delays caused by third‑party providers

9. Backups & Data

SilentNode does not guarantee backups unless explicitly stated in your plan. You are responsible for maintaining your own backups.

10. Uptime Guarantee

SilentNode strives for high availability but does not guarantee 100% uptime.

We are not liable for downtime caused by:

  • Maintenance
  • Network outages
  • Third‑party failures
  • User error
  • Force majeure events

11. Support

Support is provided through:

  • Email
  • Discord
  • Ticket system

We do not guarantee response times but aim to respond promptly.

12. Termination

SilentNode may suspend or terminate your account for:

  • Violation of these Terms
  • Abuse of services
  • Non‑payment
  • Fraudulent activity

You may terminate your service at any time through your account dashboard.

13. Refund Policy

Refunds are issued only when required by law or when SilentNode determines a refund is appropriate.

We do not offer refunds for:

  • User error
  • Misconfiguration
  • Failure to read service descriptions
  • Suspensions due to ToS violations

14. Liability Limitation

To the fullest extent permitted by law:

  • SilentNode is not liable for lost profits, data loss, downtime, or damages.
  • Our total liability will not exceed the amount you paid in the last 30 days.

15. Indemnification

You agree to indemnify and hold SilentNode harmless from any claims, damages, or losses arising from your use of our services.

16. DMCA & Copyright

SilentNode complies with the Digital Millennium Copyright Act (DMCA). We will respond to valid takedown notices and may suspend accounts hosting infringing content.

17. Privacy Policy

SilentNode collects and processes data as described in our Privacy Policy. By using our services, you consent to this processing.

18. Changes to Terms

SilentNode may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the United States.
